When to Hire a Lemon Law Lawyerin Chicago?
By Harry Bradley, Esq.
The short answer is: hire a lemon law lawyer in Chicago as soon as you suspect your vehicle has a defect the dealer cannot fix. At HC Bradley LLC, we hear from drivers every week who waited too long, hoping the next repair would finally solve the problem. By the time they called us, they had lost months of use, built up frustration, and, in some cases, come dangerously close to missing a legal deadline.
Buying a new car should be exciting. When it turns into a cycle of service appointments, loaner cars, and phone calls that go nowhere, it is easy to feel stuck. We wrote this article to help you recognize when it makes sense to bring in an attorney and explain what we can do for you once you do.
What the Illinois Lemon Law Covers
Illinois protects new car buyers through the New Vehicle Buyer Protection Act, commonly called the Illinois lemon law. In general, the law applies when a new vehicle has a defect that substantially impairs its use, market value, or safety, and the manufacturer or its authorized dealer cannot repair it after a reasonable number of attempts.
Under Illinois law, a vehicle may qualify as a lemon if a problem first reported within the first 12 months or 12,000 miles, whichever comes first, continues after repairs. The law generally presumes a reasonable number of attempts has been made when:
- The same defect has been subject to repair four or more times and still exists, or
- The vehicle has been out of service for repairs for a total of 30 or more business days.
If a vehicle qualifies, the manufacturer may have to replace it or refund the purchase price, minus a reasonable allowance for the miles you drove before the problem appeared.
Illinois law is only part of the picture. The federal Magnuson-Moss Warranty Act can protect buyers of used vehicles still under a manufacturer or dealer warranty, and it may also cover leased vehicles. Many of the drivers we help assume they have no options because their car is used or slightly outside the 12-month window. That is often not the case, which is one more reason to talk with us before you give up.
Signs It Is Time to Hire a Lemon Law Lawyer
You do not need to wait until your fourth repair attempt to contact us. The earlier we get involved, the better we can guide you through the process and protect your claim. Here are the most common situations that tell us a driver should be talking to an attorney:
- The same problem keeps coming back. If your car has returned to the shop two or three times for the same issue, it is time to make a call, even if the dealer says it is fixed.
- Your vehicle has spent weeks in the shop. Days out of service add up quickly. If your car has been sidelined for repairs for several weeks in its first year, you may be approaching the 30-business-day threshold.
- The defect affects your safety. Brake failures, steering problems, stalling, electrical fires, and airbag warnings are not inconveniences. They put you and your family at risk, and they deserve immediate attention.
- The dealer says it cannot find anything wrong. A “could not duplicate” note on a repair order does not mean the problem is in your head. We know how to document intermittent defects.
- The manufacturer is not responding. If you have reached out to the carmaker and received a vague answer, a lowball offer, or no answer at all, you need someone in your corner.
- You have been offered a “goodwill” deal. Extended warranties, service credits, or trade-in assistance can sound generous, but they are often worth far less than what the law may entitle you to.
- You are being asked to sign something. Never sign a release, settlement, or arbitration agreement before an attorney reviews it.
If any of these sound familiar, do not wait for things to get worse. Call HC Bradley LLC today at 630.453.5159 or fill out the form on this page, and we will get back to you shortly.
Why Timing Matters So Much
Lemon law claims come with strict deadlines and procedural steps, and missing one can weaken or even end a case. Under the Illinois lemon law, you generally must file a lawsuit within 18 months of the date the vehicle was originally delivered to you. That window can close faster than people expect, especially when months have already passed while you waited for repairs.
There are other steps that can trip people up along the way:
- Written notice to the manufacturer. Illinois law generally requires written notice to the manufacturer and a chance to fix the problem. A phone call to the dealership is usually not enough.
- Informal dispute programs. Some manufacturers run arbitration or dispute-resolution programs that you must use before filing a lawsuit. Knowing whether that applies to your vehicle, and how to present your case, makes a real difference.
- Repair records. Every dealership visit should produce a repair order that accurately describes your complaint. Vague or incorrect paperwork is one of the most common problems we see.
When we get involved early, we can ensure each step is handled correctly from the start, rather than trying to fix mistakes after the fact.
How We Help Chicago Drivers With Lemon Law Claims
Manufacturers have legal teams whose job is to limit what they pay. You deserve the same level of preparation. When you hire HC Bradley LLC, here is what we do:
- Review your situation honestly. We look at your purchase or lease documents, warranty, and repair history, and we tell you plainly whether we believe you have a claim.
- Organize your evidence. We gather repair orders, communications, and records of days out of service, and we fill in any gaps.
- Handle the manufacturer for you. We prepare and send the required notices and take over communication, so you no longer have to fight through customer service lines.
- Negotiate for a fair outcome. We pursue the remedy the law allows, whether that is a refund, a replacement vehicle, or a cash settlement.
- Go to arbitration or court when needed. If the manufacturer will not resolve the claim fairly, we are prepared to take the next step.
What Does It Cost to Hire a Lemon Law Lawyer?
Many drivers hesitate to call an attorney because they worry about legal fees. Under the federal Magnuson-Moss Warranty Act, a consumer who prevails may be able to recover attorney fees and costs from the manufacturer. This fee-shifting provision is designed to help ordinary people stand up to large companies. We will explain exactly how fees would work in your specific case before you commit to anything, so there are no surprises.
If you are unsure whether your car qualifies, the best way to find out is to talk with us. Call HC Bradley LLC today at 630.453.5159 or fill out the form on this page, and we will get back to you shortly.
Do Not Wait Until the Warranty Runs Out
One of the biggest mistakes we see is drivers who keep their heads down and hope the problem goes away. Meanwhile, the protection period passes, the 18-month filing deadline approaches, and the manufacturer has less reason to make things right. You shouldn’t have to live with a defective vehicle, and you shouldn’t have to navigate the system alone.
So, when should you hire a lemon law lawyer in Chicago? Our answer is simple:
- When the same defect has sent your car back to the shop more than once
- When your vehicle has been out of service for an extended period
- When a safety-related problem has not been fixed
- When the dealer or manufacturer stops giving you straight answers
- When you are offered a settlement or asked to sign paperwork
At HC Bradley LLC, we help Chicago-area drivers hold manufacturers accountable for the vehicles they sell. We listen to your story, explain your options in plain language, and fight for the result you deserve. If you think you may be driving a lemon, let us review your case.
