New Car Warranty Problems - When to Speak With a Chicago Warranty Lawyer

By Harry Bradley, Esq.

Chicago Warranty LawyerBuying a new vehicle should come with a reasonable expectation that the manufacturer will stand behind its warranty. When a serious defect appears, most owners expect the dealership to diagnose the problem, complete the repair, and return a dependable vehicle. Unfortunately, some Chicago-area drivers instead find themselves making repeated service appointments, waiting weeks for repairs, or hearing that a recurring problem is “normal.” When that happens, it may be time to speak with a Chicago warranty lawyer.

At HC Bradley LLC, we help consumers evaluate defective vehicle and warranty problems and determine whether Illinois Lemon Law protections, federal warranty laws, or other legal remedies may apply. A warranty dispute is not simply about an inconvenient repair. It can involve whether a manufacturer is fulfilling the promises made when you purchased or leased the vehicle.

When a New Car Warranty Problem Becomes More Than an Inconvenience

Not every warranty repair creates a legal dispute. New vehicles are complicated machines, and an isolated defect that is promptly corrected may simply be part of normal warranty service. Our concern increases when the same problem continues after repair attempts, the vehicle spends significant time unavailable for use, or the manufacturer refuses to provide an effective resolution.

Illinois’ New Vehicle Buyer Protection Act defines a qualifying nonconformity as a failure to conform to applicable express warranties that substantially impairs the vehicle’s use, market value, or safety. The statute’s warranty period is generally the first year or 12,000 miles following delivery, whichever occurs first. Illinois law also establishes circumstances under which a reasonable number of repair attempts may be presumed, including four or more repair attempts for the same continuing nonconformity or 30 or more business days out of service for repairs during the statutory warranty period.

Some warning signs that should prompt you to look more closely at your situation include:

  • The same defect returns after multiple warranty repairs.
  • Your vehicle has remained at the dealership for an unusually long period.
  • The manufacturer or dealer says no problem exists even though you continue experiencing the defect.
  • A serious safety, drivability, electrical, transmission, engine, braking, or other substantial problem remains unresolved.

The important point is that consumers should not assume they must simply continue returning to the dealership indefinitely. Once a pattern develops, consulting a vehicle warranty attorney in Chicago can help you understand whether the repair history has created additional legal options.

Keep Every Warranty Repair Document

When we review a potential warranty or lemon law matter at HC Bradley LLC, documentation is extremely important. A vehicle owner may remember visiting the dealership repeatedly, but the written repair orders provide a much clearer timeline of what happened.

The Illinois Attorney General specifically advises consumers to retain repair records, including the purpose and date of repairs and the amount of time the vehicle remained in the shop. We recommend keeping:

  • Every repair order, even if the dealership states that it could not duplicate the problem.
  • Records showing the dates the vehicle entered and left the repair facility.
  • Emails, text messages, letters, and other communications with the dealership or manufacturer.
  • The purchase or lease agreement, warranty information, and manufacturer correspondence.

Consistency also matters. When describing a recurring problem to the service department, explain the symptoms clearly and make sure the repair order accurately reflects your complaint. A vague description on one repair order and a completely different description on another can make the history more difficult to evaluate.

Warranty Claims and Lemon Law Claims Are Not Always the Same

One common misconception we encounter is that a vehicle must satisfy every requirement of the Illinois Lemon Law before a consumer has any potential warranty rights. That is not necessarily the case. Illinois’ Lemon Law provides specific protections for qualifying new vehicles, but other state and federal warranty laws can also be relevant depending on the circumstances.

The federal Magnuson-Moss Warranty Act addresses written warranties on consumer products and provides consumer remedies involving certain breaches of warranty and service-contract obligations. For that reason, speaking with a new car warranty dispute lawyer can be worthwhile even when you are uncertain whether your vehicle meets the traditional definition of a lemon.

When evaluating a matter, we may look closely at issues such as:

  • What the manufacturer’s written warranty promises to cover.
  • When the defect was first reported and how many repair attempts followed.
  • Whether the defect continues to substantially affect the vehicle.
  • How the manufacturer or authorized dealership responded to your requests for warranty service.

Every situation is different. A problem involving a vehicle that has been unusable for weeks presents different facts than a cosmetic defect corrected during one service appointment. Our role is to examine the complete repair history rather than making assumptions based on a single visit.

When Should You Contact a Manufacturer Warranty Claim Attorney?

We encourage vehicle owners to seek legal guidance before months of additional unsuccessful repairs create unnecessary complications. Illinois’ statutory lemon law contains specific procedural requirements and deadlines, including an 18-month limitations period for actions under the Act, and certain manufacturer dispute-resolution procedures may also apply. Waiting until long after problems begin can reduce the options available.

You should consider contacting HC Bradley LLC when your new vehicle has experienced repeated repairs, substantial downtime, a serious unresolved defect, or resistance from the manufacturer regarding warranty coverage. You do not need to determine on your own whether you already have a winning claim before speaking with us. That is precisely why consulting a manufacturer warranty claim attorney can be valuable.

At HC Bradley LLC, we understand how frustrating it is to make payments on a new vehicle while repeatedly bringing it back for warranty service. We help consumers examine their records, understand the applicable legal framework, and determine what steps may be appropriate based on the facts of their particular situation.

If a defective new vehicle has turned what should have been a reliable purchase into an ongoing repair problem, speak with a Chicago warranty lawyer before assuming that another trip to the dealership is your only option.
