When to Hire a Lemon Law Attorney
in Chicago

By Harry Bradley, Esq.

Lemon Law Attorney ChicagoIf your new car keeps going back to the dealership for the same problem, you are probably wondering when it makes sense to bring in a lawyer. At HC Bradley LLC, we hear this question from Chicago drivers every week, and our answer is simple: the sooner you talk to a lemon law attorney, the stronger your position usually is.

Many people wait until they are completely fed up, or until the manufacturer has already said no. By then, important deadlines may be close, and key paperwork may be missing. Below, we explain how the Illinois lemon law works, the signs that tell us a case is ready for an attorney, and the steps you can take today to protect yourself.

How the Illinois Lemon Law Works

Illinois protects new car buyers through the New Vehicle Buyer Protection Act, commonly called the lemon law. It covers new vehicles bought or leased in Illinois when a serious defect shows up during the first 12 months or 12,000 miles, whichever comes first.

In general, your vehicle may qualify as a lemon if a defect substantially impairs its use, value, or safety, and one of the following is true:

  • The same problem has been through four or more repair attempts without being fixed.
  • The vehicle has been out of service for repairs for a total of 30 or more business days.

The manufacturer must also be given written notice and a final chance to fix the problem. If the law applies, the manufacturer may have to replace the vehicle or buy it back, minus a reasonable allowance for your use. A claim generally must be filed within 18 months of the date the vehicle was delivered to you.

The Illinois lemon law is not the only protection available. If your vehicle is used, or the problem appeared after the first year, the federal Magnuson-Moss Warranty Act may still give you a claim when a warranty has not been honored. Sorting out which law fits your situation is one of the first things we do when you contact us.

Signs It Is Time to Hire a Lemon Law Attorney

In our experience, these are the moments when Chicago drivers should stop handling things alone and call an attorney.

  1. The same problem keeps coming back. If the dealer has tried to fix the same defect two or three times and it returns, you are already close to the legal threshold. This is the ideal time to call, before the next repair visit.
  2. Your car has spent weeks in the shop. Days out of service add up quickly. If your vehicle has been gone for several weeks this year, the 30-business-day mark may be nearer than you think.
  3. The defect affects your safety. Brake failures, stalling, steering problems, airbag warnings, and electrical fires are not issues to wait on. Your safety comes first, and these defects also tend to make strong claims.
  4. The dealer says it “cannot duplicate” the problem. A repair order that says no problem was found can still count as a repair attempt, but only if it is documented correctly. We help make sure your visits are recorded in a way that supports your claim.
  5. The manufacturer made you an offer. Manufacturers sometimes offer an extended warranty, a small payment, or a trade-in discount. These offers are often worth far less than what the law may provide. Talk to us before you sign anything.
  6. You are being sent to an arbitration program. Some manufacturers require you to use an informal dispute program before filing suit. How you present your case there matters, and the result can affect what happens next.
  7. Your deadlines are approaching. If you are nearing 12 months or 12,000 miles, or it has been over a year since delivery, do not wait. Missing a deadline can end a claim that would otherwise have been strong.

Why Waiting Can Hurt Your Case

We understand why people hesitate. It is natural to give the dealer one more try, or to hope the next software update solves the problem. But waiting has real costs.

Evidence gets lost. Repair orders go missing, and memories of dates and conversations fade. Mileage keeps climbing, which can reduce what you recover and push you past the coverage window. Most importantly, the 18-month filing deadline does not pause while you wait for the manufacturer to do the right thing.

When we get involved early, we can guide how your remaining repair visits are handled and documented. We can also send proper written notice to the manufacturer, so your case is built correctly from the start instead of pieced together later.

What It Costs to Work with a Lemon Law Attorney

Many drivers assume a lawyer is out of reach for a car problem. In lemon law and warranty cases, that is often not the case. Federal warranty law allows consumers who win to recover attorney fees from the manufacturer in many situations. We will explain exactly how fees work for your case during your first conversation with us, so there are no surprises.

What to Do Before You Call Us

You do not need to have everything organized to reach out. Still, gathering these items will help us review your situation quickly:

  • Your purchase or lease agreement and warranty documents
  • Every repair order and invoice, including visits where no problem was found
  • A simple log of dates, symptoms, and how long the car was in the shop
  • Any letters, emails, or texts with the dealer or manufacturer
  • Photos or videos of the problem, such as warning lights or noises

Avoid selling or trading in the vehicle before you talk to us. Doing so can complicate or limit your options.

Why Chicago Drivers Choose HC Bradley LLC

We focus on helping consumers stand up to large manufacturers that have teams of lawyers on their side. We know how frustrating it is to make payments on a car you cannot trust, and we treat every client’s case with the attention it deserves. From your first call, we review your documents, explain your options in plain language, and handle communication with the manufacturer so you can focus on your daily life.

Whether you drive in the Loop, commute from the suburbs, or live anywhere in the Chicago area, we are ready to help you understand whether your vehicle qualifies and what your claim may be worth.

The Bottom Line

So, when should you hire a lemon law attorney in Chicago? The best time is as soon as a serious defect returns after a repair, or as soon as your car starts spending more time in the shop than in your driveway. You do not have to wait until you are certain your car is a lemon. Figuring that out is our job.
