Filing a Lemon Law Claim
in Illinois

HC Bradley LLC understands the frustration and disappointment that comes with purchasing a vehicle you believe will be reliable, only to discover it spends more time in the shop than on the road. If this sounds familiar, you’re not alone. Every year, countless Illinois consumers find themselves with what’s commonly known as a “lemon.” Fortunately, the Illinois Lemon Law exists to protect you, and our team at HC Bradley LLC is here to walk you through the entire claims process from start to finish.

Let me explain how our firm handles Lemon Law cases in Illinois and what you can expect if you decide to work with us.

Step 1: Initial Consultation

Understanding Car Lemon LawThe very first step in filing a lemon law claim with HC Bradley LLC is reaching out to us for a free initial consultation. This is your chance to tell us your story. We’ll ask questions about your vehicle, when you purchased it, how many miles were on it at the time of purchase, what kinds of repairs it has needed, and how often those issues have recurred. We also review whether the repairs were performed by an authorized dealer, and if the vehicle was out of service for an extended period.

During this conversation, we’re evaluating whether your vehicle meets the criteria under the Illinois New Vehicle Buyer Protection Act, commonly referred to as the Illinois Lemon Law. In Illinois, the law applies to new vehicles within the first 12 months or 12,000 miles (whichever comes first), and it typically requires that the manufacturer has had a reasonable number of attempts to repair the issue.

If you’re unsure whether your vehicle qualifies, don’t worry. That’s why we’re here. Call HC Bradley LLC today at (630)453-5159 or fill out the form on this page and we will get back to you shortly to help determine if you have a valid lemon law case.

Step 2: Documentation and Case Evaluation

If we believe your vehicle may qualify under Illinois Lemon Law, we move forward by gathering your vehicle service records, purchase or lease agreement, manufacturer’s warranty, and all communication with the dealership or manufacturer. This paperwork is crucial for building your case.

We look closely at the types of defects and how they affect the safety, use, or value of the vehicle. We also assess how many repair attempts were made and whether the dealer had sufficient time to fix the issue. In Illinois, if your vehicle has had four or more unsuccessful attempts to repair the same problem or has been out of service for 30 or more cumulative days within the first year or 12,000 miles, you may be eligible for relief under the lemon law.

At HC Bradley LLC, we don’t just check boxes. We take the time to listen, review your documents carefully, and build a strong, tailored legal strategy.

Step 3: Filing a Formal Lemon Law Claim

Once we confirm that your case is eligible under Illinois law, we prepare and file a formal lemon law demand notice to the manufacturer. This includes a detailed account of your vehicle’s problems, the repair history, and your request for an appropriate resolution, which might be a full refund, replacement vehicle, or cash settlement.

Manufacturers don’t always respond promptly or favorably. That’s where our experience comes in. We’ve handled countless lemon law claims and know how to deal with car companies and their legal teams. We push hard to resolve the claim without unnecessary delays, but we’re also fully prepared to take the case to arbitration or court if that’s what it takes to get you the compensation you deserve.

And don’t worry about upfront legal fees. In many cases, Illinois Lemon Law allows us to recover attorney’s fees from the manufacturer, so you don’t pay us out of pocket.

Step 4: Negotiation and Resolution

The majority of lemon law claims we handle never go to trial. Instead, they are resolved through direct negotiation or arbitration. We work closely with the manufacturer or their legal representatives to reach a resolution that fully compensates you for your lemon vehicle.

Whether you’re entitled to a buyback (refund of your purchase price minus a usage fee), a new replacement vehicle, or a cash compensation settlement, we advocate for what’s fair based on your circumstances. You don’t have to navigate this alone or deal with intimidating corporate lawyers, we take care of that for you.

At this stage, our clients are often relieved to see the light at the end of the tunnel. Many express regret that they didn’t reach out to us sooner. If you think your vehicle might be a lemon, don’t wait, call HC Bradley LLC today at (630)453-5159 or fill out the form on this page and we will get back to you shortly.

Step 5: Finalizing the Claim and Moving On

Once we reach a resolution, we make sure all paperwork is completed and any agreed-upon funds or vehicle exchanges are handled smoothly. You’ll receive written documentation of the agreement, and we’ll follow through to ensure the manufacturer holds up their end of the deal.

Many of our clients tell us they finally feel a sense of closure once the case is finalized. Our goal isn’t just to win your case, it’s to restore your peace of mind. Getting stuck with a lemon can be overwhelming, but with the right legal team by your side, it becomes manageable.
