How the Lemon Law was Created
in Illinois

At HC Bradley LLC, we’ve spent years helping Illinois consumers stand up for their rights under the state’s Lemon Law. Many of our clients come to us frustrated and unsure of what to do after realizing their new car isn’t living up to expectations. Maybe it’s a strange rattle that keeps coming back after repairs. Maybe it’s a warning light that won’t stay off. Or maybe it’s repeated visits to the dealership without a real fix in sight. Whatever the issue, we’re here to help.

To understand how we protect consumers today, it’s important to understand how the Lemon Law came to exist in Illinois in the first place, and why hiring a Lemon Law lawyer can make the difference between getting stuck with a defective vehicle and getting the justice you deserve.

Illinois’ Lemon Law was born out of consumer frustration. In the late 1970s and early 1980s, the auto industry was booming, but not every car rolling off the assembly line met quality standards. Consumers were often left holding the bag when a new vehicle turned out to be unreliable, unsafe, or outright defective.

Before any formal Lemon Law existed, a buyer’s only recourse was to rely on warranty promises or file a breach of contract lawsuit against a large automaker, a difficult, expensive, and time-consuming process. Lawmakers began to recognize that this imbalance of power between manufacturers and consumers wasn’t fair or sustainable.

This led to a wave of consumer protection legislation across the United States. In 1982, Connecticut became the first state to enact a “Lemon Law.” Other states soon followed, and Illinois passed its own version, officially titled the Illinois New Vehicle Buyer Protection Act, in 1983.

The Illinois Lemon Law was designed to do one thing: protect consumers who purchase or lease new vehicles that turn out to have serious, unfixable defects. It ensures that manufacturers, not consumers, bear the cost of producing a faulty vehicle.

What the Illinois Lemon Law Covers

The Illinois Lemon Law applies to new cars, SUVs, vans, and certain recreational vehicles purchased or leased in the state. It covers major defects that substantially impair the use, market value, or safety of the vehicle and occur within 12 months or 12,000 miles, whichever comes first.

If a manufacturer or dealership cannot repair the problem after four attempts, or if the vehicle is out of service for 30 or more business days, the consumer may be entitled to a replacement vehicle or a full refund.

While this sounds straightforward on paper, the process of proving your vehicle qualifies as a “lemon” can be complex. Manufacturers often push back, arguing that the defect isn’t serious enough, that the consumer caused the problem, or that more repair attempts are needed. That’s where having an experienced Illinois Lemon Law attorney becomes invaluable.

Why the Illinois Lemon Law Was Created, The Consumer’s Voice

The creation of the Illinois Lemon Law was a response to real stories from real people. Everyday drivers were facing ongoing car problems, spending countless hours at repair shops, and losing confidence in their vehicles. Yet, they were often told by dealers that “nothing could be done” or that they had to keep bringing it in for the same issue again and again.

Illinois lawmakers realized that consumers needed a fair and practical remedy for these situations, something faster and more affordable than taking a car manufacturer to court. The Lemon Law gave power back to the buyer, ensuring that if a new vehicle didn’t meet the standards promised by the manufacturer, the consumer would not be left paying for it.

Today, that same law still stands as a safeguard for Illinois car buyers, although it’s been refined over the years to account for new vehicle technologies and warranty structures.

Why You Should Hire a Lemon Law Lawyer

Even though the Lemon Law exists to protect you, it doesn’t automatically enforce itself. That’s why having an experienced Lemon Law lawyer on your side can make all the difference. Here’s why:

  1. We Know the Law Inside and Out
At HC Bradley LLC, we understand how manufacturers operate. They have teams of attorneys trained to minimize payouts. We know how to gather documentation, interpret repair records, and present a compelling case that clearly demonstrates your vehicle qualifies as a lemon under Illinois law.
  2. We Deal With the Manufacturer So You Don’t Have To
If you’ve ever tried dealing with a car manufacturer directly, you know how stressful it can be. There’s red tape, endless phone calls, and confusing paperwork. We handle all communications and negotiations on your behalf, allowing you to focus on getting back on the road.
  3. You Could Recover More Than You Think
Many people don’t realize that under Illinois law, if your vehicle qualifies as a lemon, the manufacturer may be required to cover your attorney’s fees and costs. That means you can often pursue your claim without paying out of pocket.
  4. We Protect You From Settlement Traps
Manufacturers sometimes offer partial refunds or trade-ins that sound fair, but often aren’t. We make sure you don’t accept a settlement that undervalues your rights. Our job is to get you the full remedy you’re entitled to: a replacement vehicle or a refund, not a compromise that benefits the automaker.

If you’re unsure whether your car qualifies, Call HC Bradley LLC today at 630.453.5159 or fill out the form on this page and we will get back to you shortly.
