Understanding Indiana’s Lemon Law

Indiana’s Lemon Law applies to new vehicles purchased or leased in the state that develop significant defects during the first 18 months or 18,000 miles, whichever comes first. These defects must substantially impair the vehicle’s use, value, or safety, and the manufacturer must have been given a reasonable number of attempts to repair the issue.

If those repair attempts fail, the consumer may be entitled to a replacement vehicle or a refund, but reaching that outcome isn’t always simple. Automakers and dealerships often push back, delay, or deny claims altogether, which is why legal guidance is so critical.

Step 1: Identify and Document the Problem

The first and most important step in an Indiana Lemon Law claim is documentation. Every time your vehicle is serviced, make sure you receive a written repair order that lists:

  • The date of service
  • The reported problem
  • The diagnosis and repair performed
  • The mileage at the time of service

We always tell clients that good documentation is the foundation of a successful Lemon Law case. Without it, the manufacturer can argue that you didn’t give them a fair chance to fix the problem.

Also, keep copies of all correspondence, emails, texts, letters, and even notes from phone calls with the dealer or manufacturer. The more proof you have, the stronger your claim becomes.

Step 2: Give the Manufacturer a Reasonable Opportunity to Repair

Under Indiana law, you must give the manufacturer a reasonable number of repair attempts before filing a claim. Generally, that means:

  • Four or more repair attempts for the same issue, or
  • One repair attempt for a defect likely to cause serious injury or death, or
  • The vehicle is out of service for at least 30 business days due to repairs.

These requirements show that you gave the manufacturer a fair opportunity to correct the defect. Once this threshold is met and the problem still persists, your car may legally qualify as a lemon.

Step 3: Notify the Manufacturer

Before filing a formal claim, Indiana’s Lemon Law requires consumers to notify the manufacturer in writing about the ongoing defect and request that it be fixed or that the vehicle be replaced or refunded.

The manufacturer usually has a final opportunity to repair the vehicle after receiving this written notice. Many automakers have special departments or arbitration programs for lemon-related complaints.

However, these arbitration programs can sometimes be biased in favor of the manufacturer, which is one of the main reasons vehicle owners turn to us for legal help.

At this stage, having a lawyer ensures your notice is properly drafted, submitted to the right party, and backed by evidence that’s difficult for the manufacturer to ignore.

Step 4: Filing a Lemon Law Claim

If the manufacturer fails to repair or replace your vehicle after being notified, it’s time to file a formal Lemon Law claim. This is where my team at HC Bradley LLC steps in.

We handle everything, from preparing the necessary documentation to negotiating directly with the manufacturer or their attorneys. If the automaker refuses to do what’s right, we’re ready to take your case to court and fight for your rights under Indiana law.

Our goal is simple: to help you recover the compensation or replacement vehicle you deserve as quickly and efficiently as possible.

Why You Should Hire a Lemon Law Lawyer

Many vehicle buyers wonder, “Can’t I just handle a Lemon Law claim on my own?” Technically, you can, but it’s rarely a good idea. Here’s why hiring a lemon law lawyer like HC Bradley LLC gives you a major advantage:

  1. We Understand the Law Inside and Out

Indiana’s Lemon Law and related federal protections (like the Magnuson-Moss Warranty Act) are complex. One small mistake in your paperwork or a missed deadline can jeopardize your claim. Our experience ensures that doesn’t happen.

  1. We Handle the Stress for You

Dealing with manufacturers can be time-consuming and emotionally draining. We take over all communication and negotiation so you can focus on your life, not on endless phone calls or emails with the dealership.

  1. You Pay Nothing Unless We Win

In most Lemon Law cases, the manufacturer is required to pay your attorney’s fees if your claim is successful. That means we can represent you without you paying out-of-pocket legal fees.

  1. We Maximize Your Recovery

A skilled lemon law lawyer can often secure a better outcome than consumers can on their own, including full refunds, vehicle replacements, or additional compensation for incidental costs such as towing, rental cars, or loss of use.

Step 5: Receiving Your Settlement or Replacement

  • Once your case is resolved, you may be entitled to:
  • A replacement vehicle of comparable value, or
  • A refund that includes the purchase price, taxes, registration fees, and other related expenses (minus a small mileage offset).

At HC Bradley LLC, Harry Bradley oversees every case to make sure clients receive the fair outcome they deserve. We keep you informed at every step and fight aggressively to ensure the manufacturer honors its obligations.

Don’t Wait, Take Action Today

Lemon Law claims in Indiana are subject to strict time limits, and the longer you wait, the harder it can be to prove your case. If you suspect your vehicle qualifies as a lemon, the best thing you can do is act now.

You don’t have to navigate this process alone, we’re here to guide you through every stage and protect your rights as a consumer.
