Lemon Law 815 ILCS 380

Lemon Law 815 ILCS 380At HC Bradley LLC, we view 815 ILCS 380 as a consumer protection statute designed to level the playing field between individual vehicle buyers and large manufacturers. In practical terms, the law applies to new vehicles purchased or leased in Illinois that turn out to have significant defects affecting their use, value, or safety.

To qualify under the statute, several key criteria must be met:

  • The defect must arise within the first 12 months or 12,000 miles, whichever comes first
  • The issue must be substantial, not cosmetic or minor
  • The manufacturer must be given a reasonable number of attempts to repair the issue

In most cases, “reasonable attempts” means:

  • At least 4 repair attempts for the same defect, OR
  • The vehicle is out of service for 30 or more business days

When these thresholds are met, the law entitles the consumer to either:

  • A replacement vehicle, or
  • A full refund, minus a small usage allowance

How Lemon Law Applies in DuPage County

While the statute is statewide, enforcement and legal processes often play out locally. In DuPage County, consumers frequently face challenges not because the law is unclear, but because manufacturers and dealerships resist compliance.

We’ve seen cases where:

  • Dealers downplay recurring issues
  • Manufacturers delay repair timelines
  • Warranty claims are denied or minimized

This is where localized legal representation becomes critical. At HC Bradley LLC, we understand how lemon law cases are handled within DuPage County courts and arbitration systems, and we tailor our approach accordingly.

What Qualifies as a “Substantial Defect”?

One of the most misunderstood aspects of lemon law is what constitutes a “substantial defect.” At HC Bradley LLC, we help clients identify qualifying issues such as:

  • Engine or transmission failure
  • Brake system defects
  • Electrical system malfunctions
  • Steering or suspension issues
  • Persistent warning lights tied to safety systems

A defect does not need to make the vehicle completely inoperable, it simply needs to significantly impair the vehicle’s use, value, or safety.

For example, a vehicle that stalls unpredictably or has chronic braking issues clearly meets the threshold, even if it still runs.

Why Hiring a Lemon Law Lawyer Matters

From our experience at HC Bradley LLC, one of the biggest mistakes consumers make is attempting to handle lemon law claims on their own. While the statute appears straightforward, the process is anything but.

Here’s why legal representation is critical:

  1. Manufacturers Have Legal Teams, You Should Too
Automakers are not passive participants. They are backed by experienced legal departments whose sole purpose is to minimize payouts. Without representation, you are at an immediate disadvantage.

We know how manufacturers structure their defenses—and more importantly, how to counter them.

  2. Proper Documentation Is Everything
A successful lemon law claim hinges on documentation:
    • Repair orders
    • Service records
    • Dates and mileage logs
    • Communication with dealerships

At HC Bradley LLC, we don’t just review your documents, we build a structured case that aligns precisely with statutory requirements under 815 ILCS 380.

  1. Maximizing Your Compensation
Many consumers assume their only option is a vehicle swap. In reality, compensation can include:
    • Full purchase refund
    • Taxes and registration fees
    • Finance charges
    • Incidental costs

We ensure that nothing is left on the table.

  1. Legal Fees Are Often Covered
One of the most overlooked advantages of lemon law claims is that the manufacturer typically pays the attorney’s fees if you win. That means hiring HC Bradley LLC often comes at no out-of-pocket cost to you.

This removes the financial barrier that prevents many consumers from pursuing rightful claims.

  2. Avoiding Costly Mistakes
We frequently see cases where consumers:
    • Wait too long to file
    • Accept inadequate settlements
    • Fail to meet procedural requirements

These missteps can permanently weaken or even invalidate a claim. With our guidance, you avoid these pitfalls entirely.

If you’re currently dealing with repeated repairs or a defective vehicle, don’t navigate this alone. Call HC Bradley LLC today at 630.453.5159 or fill out the form on this page and we will get back to you shortly.
