Lemon LawDuPage CountyExplained
When a person in DuPage County buys or leases a new vehicle, they expect it to be safe, reliable, and ready for everyday use. Whether that vehicle is used for commuting on I-355, driving through Naperville, getting to work in Wheaton, or handling family responsibilities in Downers Grove, it should not spend more time in the repair bay than on the road. At HC Bradley LLC, we understand how frustrating it can be when a new vehicle develops repeated problems and the manufacturer or dealership cannot seem to fix them.
Illinois’ Lemon Law is designed to protect consumers when a new vehicle has a serious defect that substantially affects the vehicle’s use, safety, or market value. The Illinois Attorney General explains that Illinois Lemon Law coverage generally applies when a new vehicle has a significant issue during the first year of ownership.
What Is the Lemon Law in DuPage County?
DuPage County vehicle buyers are protected under Illinois Lemon Law. This means that the same statewide consumer protections apply whether the vehicle was purchased or leased in Naperville, Wheaton, Glen Ellyn, Lombard, Elmhurst, Downers Grove, Westmont, Oak Brook, Lisle, Carol Stream, or another DuPage County community.
In general, the Illinois Lemon Law may apply when a new vehicle has a defect or condition that cannot be repaired after a reasonable number of attempts. According to Illinois consumer protection guidance, the problem must substantially impair the vehicle’s use, market value, or safety.
That distinction matters. A minor inconvenience may not rise to the level of a lemon law claim. But a recurring engine issue, electrical malfunction, brake defect, transmission problem, steering concern, safety system failure, or water intrusion issue may be much more serious.

When Does a Vehicle Qualify as a Lemon in Illinois?
A vehicle may qualify as a lemon when the manufacturer or authorized dealer has had enough opportunities to fix the same substantial defect but the issue continues. Illinois Lemon Law standards commonly focus on whether the defect occurs within the first 12 months or 12,000 miles, whichever comes first, and whether the vehicle has been subject to repeated repair attempts or extended time out of service. HC Bradley LLC’s own guidance notes that a vehicle may qualify if it has had four or more attempts to repair the same problem or has been out of service for 30 or more business days within the first 12 months or 12,000 miles, whichever comes first.
A lemon law issue may involve problems such as:
- Repeated check engine lights that return after service
- Transmission slipping, jerking, or failing to shift properly
- Braking problems that affect driver confidence or safety
- Electrical failures involving displays, sensors, batteries, or control modules
- Steering, suspension, or alignment issues that make the vehicle difficult to control
- Water leaks, mold concerns, or interior damage caused by faulty seals
- Safety technology failures involving airbags, cameras, warning systems, or driver-assist features
- Engine stalling, rough operation, loss of power, or repeated no-start conditions
The key issue is not simply whether the vehicle has been repaired. The real question is whether the defect has been fixed in a lasting and reliable way.
Why DuPage County Buyers Should Take Repair Records Seriously
One of the biggest mistakes vehicle buyers make is assuming the dealership’s service department will automatically document everything in a way that protects the customer. In a lemon law claim, paperwork matters. Repair orders, service invoices, warranty documents, tow records, rental car receipts, emails, text messages, and manufacturer communications can all help show the history of the problem.
At HC Bradley LLC, we encourage buyers to keep a careful record of:
- The date each issue first appeared
- The mileage at each repair visit
- The exact complaint reported to the dealership
- The dealership’s diagnosis
- What parts were replaced or repairs were attempted
- How long the vehicle was unavailable
- Whether the same issue returned after service
- Any communication with the manufacturer or dealer
This documentation can make a major difference. A manufacturer may describe a problem as isolated, intermittent, or resolved. The buyer’s records may show a very different story: repeated symptoms, repeated repair visits, and a vehicle that still does not perform as promised.
The Manufacturer Is Not Automatically on Your Side
Many buyers assume that because the vehicle is under warranty, the manufacturer will do the right thing without pressure. Sometimes that happens. Often, it does not. Manufacturers may deny that a defect is substantial, argue that the vehicle is operating as designed, claim the issue cannot be duplicated, or attempt to delay the claim until the buyer becomes frustrated and gives up.
That is one of the reasons a lemon law lawyer can be so important. A lawyer understands how to evaluate the repair history, identify the legal issues, communicate with the manufacturer, and pursue the remedy the buyer may be entitled to under the law.

What Remedies May Be Available?
If a vehicle qualifies under the Illinois Lemon Law, the buyer may be entitled to a legal remedy. Depending on the facts, that remedy may include a replacement vehicle or a refund. The exact outcome depends on the vehicle, the warranty history, the repair timeline, the nature of the defect, and the manufacturer’s response.
For many buyers, this is where the process becomes difficult. The manufacturer may offer less than the buyer deserves. The manufacturer may try to frame the issue as a warranty inconvenience instead of a legal claim. The manufacturer may also rely on technical language that makes the buyer feel uncertain about their rights.
A lemon law lawyer can help determine whether the offer is fair, whether the vehicle appears to qualify, and whether additional legal pressure is needed.
Why Should Vehicle Buyers Hire a Lemon Law Lawyer?
Vehicle buyers should consider hiring a lemon law lawyer because lemon law claims are not just about frustration; they are about proof, timing, legal standards, and negotiation. Even when the facts seem obvious to the buyer, the manufacturer may challenge the claim.
A lemon law lawyer can help by:
- Reviewing the purchase or lease documents
- Evaluating repair orders and warranty history
- Determining whether the defect may substantially impair use, value, or safety
- Identifying whether the repair attempts or days out of service support a claim
- Communicating with the manufacturer on the buyer’s behalf
- Pushing back against delay tactics or low-value offers
- Explaining whether a refund, replacement, or other resolution may be appropriate
- Helping the buyer avoid mistakes that could weaken the claim
At HC Bradley LLC, we know that buyers often contact us after they have already spent months dealing with service appointments, missed work, rental vehicles, and unreliable transportation. By that point, they are tired of repeating the same story to the dealership. Our role is to step in, review the facts, and help the buyer understand the legal path forward.
Local Representation for DuPage County Vehicle Buyers
DuPage County is a large and busy area, and many residents depend on their vehicles every day. A defective new vehicle can disrupt work, school, medical appointments, family schedules, and personal safety. When a vehicle repeatedly fails despite warranty repairs, the buyer should not feel trapped.
Our firm helps consumers understand whether their situation may fall under Illinois Lemon Law protections. We look beyond the surface-level repair history and consider the full pattern of the vehicle’s problems. A single repair visit may not tell the whole story. Multiple visits, repeated symptoms, unresolved complaints, and long periods without the vehicle may point to a much stronger claim.
Do Not Wait Too Long to Ask Questions
Timing can matter in lemon law cases. Because Illinois Lemon Law protections are tied to specific time and mileage windows, buyers should not wait until the problem has dragged on for years before asking for legal guidance. The sooner a buyer understands their rights, the easier it may be to preserve records, track repair attempts, and avoid unnecessary mistakes.
If your new vehicle has been back to the dealership again and again, or if it has been unavailable for an extended period because of warranty repairs, it may be time to speak with a lawyer. You do not have to keep guessing whether the manufacturer is treating you fairly.
