The Lemon Law
in Indiana

Lemon Law in IndianaBuying a vehicle is one of the most significant purchases most people make. When we work with clients who have just invested thousands of dollars into a car, truck, or SUV, they expect reliability, safety, and performance. Unfortunately, that is not always what they receive. Some vehicles develop persistent mechanical issues that the dealership cannot fix despite multiple attempts. When this happens, the vehicle may qualify as a “lemon.”

At HC Bradley LLC, we regularly help consumers understand their rights under the Indiana Lemon Law and guide them through the process of pursuing compensation, a replacement vehicle, or a refund. Find out how Indiana’s Lemon Law works and why hiring a lemon law lawyer can make a substantial difference in the outcome of your case.

What Is the Indiana Lemon Law?

The Indiana Lemon Law is designed to protect consumers who purchase or lease vehicles that have significant defects. The law applies when a vehicle has a substantial defect that impairs its use, value, or safety, and the manufacturer or dealer cannot repair the problem within a reasonable number of attempts.

Under Indiana law, a vehicle may qualify as a lemon if:

  • The defect occurs within the first 18 months after delivery or within 18,000 miles, whichever comes first.
  • The manufacturer or dealership has made at least four attempts to repair the same issue without success.
  • The vehicle has been out of service for at least 30 cumulative days due to warranty repairs.

When these conditions are met, the manufacturer may be required to replace the vehicle or refund the purchase price, minus a reasonable allowance for mileage.

However, the process is rarely as simple as it sounds. Manufacturers often challenge claims or attempt to delay resolution. This is why understanding your legal rights and working with an experienced lemon law lawyer is so important.

Common Vehicle Defects That Lead to Lemon Law Claims

Over the years, we have seen a wide range of defects that lead consumers to pursue lemon law claims. These issues are not minor inconveniences, they often affect the safety and reliability of the vehicle.

Some of the most common defects include:

  • Engine Problems – Engine failures, stalling, or excessive oil consumption can make a vehicle unreliable and dangerous. When these issues persist despite repeated repairs, they may qualify under the Lemon Law.
  • Transmission Failures – Transmission slipping, delayed shifting, or sudden loss of power can significantly impair a vehicle’s performance and safety.
  • Electrical System Malfunctions – Modern vehicles rely heavily on complex electronics. Faulty sensors, malfunctioning infotainment systems, or persistent warning lights can indicate deeper electrical problems.
  • Brake or Steering Issues – Defects affecting steering control or braking systems can pose serious safety risks to drivers and passengers.
  • Persistent Warning Lights – If dashboard warning lights repeatedly appear despite repairs, it may indicate an unresolved underlying defect.

When dealerships repeatedly fail to fix these problems, consumers often feel frustrated and powerless. That is when legal guidance becomes critical.

Why Vehicle Buyers Should Hire a Lemon Law Lawyer

Many vehicle owners initially try to resolve lemon law issues directly with the dealership or manufacturer. Unfortunately, this approach often leads to delays, denials, or settlements that fall far short of what the law allows.

Here are several reasons why hiring a lemon law lawyer can be extremely beneficial.

  1. Understanding the Law and Your Rights – Lemon laws involve detailed requirements regarding documentation, repair attempts, timelines, and manufacturer responsibilities. A lawyer ensures that your claim meets all legal criteria and is properly presented.

Without legal guidance, consumers may unknowingly miss important deadlines or fail to gather the evidence necessary to support their claim.

  2. Handling the Manufacturer’s Legal Team – Auto manufacturers have experienced legal teams dedicated to protecting their interests. Trying to negotiate with them alone can be intimidating and ineffective.

When we represent clients at HC Bradley LLC, we communicate directly with the manufacturer and their attorneys. This levels the playing field and ensures that consumers are treated fairly.

  3. Properly Documenting the Claim – Successful lemon law claims rely heavily on documentation, including:
      • Repair orders
      • Service records
      • Warranty information
      • Purchase agreements
      • Communication with the dealership

We help clients organize and present this evidence in a way that clearly demonstrates the pattern of defects and failed repair attempts.

  1. Maximizing Compensation – Many consumers do not realize the full compensation they may be entitled to under the law. Depending on the circumstances, a lemon law claim may result in:
      • A full vehicle refund
      • A replacement vehicle
      • Reimbursement of registration fees and taxes
      • Payment for towing or rental costs

Legal representation helps ensure that manufacturers comply fully with their obligations.

The Lemon Law Claim Process in Indiana

Understanding how the lemon law process works can help reduce stress and confusion. While each case is unique, most claims follow a similar path.

Step 1: Document the Defects – The first step is keeping thorough records of all vehicle issues and repair attempts. Every service visit should generate a written repair order describing the problem.

Step 2: Allow Reasonable Repair Attempts – Indiana law requires manufacturers to have a reasonable opportunity to repair the defect. This usually means multiple repair attempts for the same issue.

Step 3: Notify the Manufacturer – Before filing a claim, the consumer typically must notify the manufacturer of the ongoing problem and provide a final opportunity to repair the vehicle.

Step 4: Pursue Legal Action if Necessary – If the manufacturer fails to resolve the issue, a lemon law lawyer can pursue compensation through negotiation, arbitration, or litigation.

At HC Bradley LLC, we guide clients through every stage of this process to ensure their rights are protected.
