Understanding Indiana’s Car Lemon Law
Purchasing a car is often a significant investment, and consumers rightfully expect their vehicles to function properly. However, sometimes unforeseen issues arise, leaving buyers frustrated and feeling cheated. This is where car lemon laws come into play, offering protection to consumers who unknowingly purchase defective vehicles. In Indiana, the car lemon law provides specific rights and remedies to buyers who find themselves stuck with a faulty vehicle. If you believe you have a claim under Indiana’s car lemon law, seeking legal assistance from firms like HC Bradley LLC can be pivotal in navigating the complexities of the legal process.
One of the biggest tell-tale signs that a car is a lemon is repeated repairs for the same issue that remain unresolved. If you’ve taken your vehicle to the dealership multiple times for the same mechanical or safety defect, like engine failure, transmission problems, or brake issues, and the problem still persists, there’s a good chance your car qualifies as a lemon under state or federal lemon laws. These defects not only disrupt your daily life but also put your safety at risk.
That’s where HC Bradley LLC comes in. As a leading lemon law firm, HC Bradley LLC has extensive experience helping frustrated car owners take legal action against manufacturers. What is the Indiana Car Lemon Law?
The Indiana car lemon law, officially known as the “Motor Vehicle Protection Act” (Indiana Code § 24-5-13), offers protection to consumers who purchase or lease new vehicles with substantial defects. This law applies to new vehicles, including cars, trucks, motorcycles, and vans, purchased or leased in Indiana for personal, family, or household use. It doesn’t cover vehicles purchased for business or commercial purposes.
Qualifying as a Lemon in Indiana
To qualify as a lemon under Indiana car lemon law, the vehicle must meet specific criteria. These criteria could be one or more of the following:
Defective Part or Parts: The defect or nonconformity must substantially impair the vehicle’s use, value, or safety.
Attempts to Repair: The consumer must have made a reasonable number of attempts to repair the defect. Indiana lemon law generally defines this as four or more attempts or the vehicle being out of service for repairs for a cumulative total of 30 days or more.
Time Limit: The defect must occur within the first 18,000 miles of operation or within the first 18 months after the vehicle’s original delivery to the consumer, whichever comes first.
If your vehicle meets these criteria, you may have a claim under Indiana’s lemon law.
